I wonder what will happen if the govt rules against BYU. Will it be a full-fledged pitched battle on the frong page of national news? Will the church be going to war (again) over discriminating against gays?

So you ask, is it discriminating against gay persons? Of course it is. It?s just a matter of your belief on whether it is correct or not, under the law, to do so. And also whether it is correct under God?s law.
