I would also add that since the legislators were, indeed, elected by the people, and because they were really the ones that created the basis for this opinion, the claim that the California Supreme Court overruled the will of the people isn't a fair claim.

It kind of highlights a conflict between a republican, representational form of government and a pure democratic form. The elected representatives passed a statutory scheme treating same sex couples the same as heterosexual couples. Proposition 22 was a pure democratic, majority of the people thing that apparently has conflicted with the laws by the representatives.

I really don't like the whole proposition thing, primarily because it favors those who can put the most money into an advertising/propaganda campaign, and they are often passed based on deception and lies.

Yes and no- let me explain:

Alcoholism can be the result of a genetic and/or psychological disease, but drinking alcohol is a choice. The best option may be to never take that first drink that gets you addicted.

Homosexuality can be the result of a genetic and/or psychological disease, but having homosexual relations is a choice. The best option is to never act on any counter-biological desires or temptations.

Of course, religion pushes this rational (that homosexuality is dangerous) much stronger than accepted physiology, though the studies, statistics, books, and reports are all out there for popular consumption.

how is homosexuality counter-biological? It seems that the problem is indeed it is biological.

also, not sure it is great form to refer to homosexuality as a "disease."
