Default A judge Obama could appreciate

the Supreme Court justice who rescinded an order for a boy to be returned to his father. Even though his continued presence in Brazil is a violation of their own law, and international agreements.

The judge is concerned that it is too abrupt for the boy, and would be cruel.

So basically, because he thinks it might hurt the boys feelings, he ignores the law.

Which, as we now, is a perfect example of "judicial empathy" the trait that Obama, editor of Harvard Law Review, thinks is the most important judicial philosophy.

Forget what the words say. What does your gut say? I would hope that a Brazilian with his bronze skin, having lived in Brazil, would make a more correct judicial decision than a white male. Duh.
