The legal analysis despite the best minds at work at it is poor. But often we get poor work when somebody wants something bad enough. The ends always justify the ends if the ends are just.
Bad facts make bad law.

As a constant and habitual lurker here on cougarguard I wanted to voice my concern over this issue. I agree very much with Mike and Arch that Prop 8 was a bad law, but it was the voice of the people. It was the voice of 7 million people in an election that voted into office the single most radical liberal EVER to hold the office of president. In a state he won by 70%. No one can say it was the conservative right that pushed this agenda.
