Did they say the guy was "wandering around with lock cutters"? I believe they saw the bike one day, then came back for it the next when they saw it was still there.
As for going to a lawyer ... that was a smart move, considering they knew they had committed petty larceny. I'd probably have gone to a lawyer too if I knew I'd committed a crime.
As I said, I'm not defending these two. It was a stupid thing to do. But prosecuting isn't going to do any good or bring any justice. It just sounds like a page out of MikeWaters-style vindictiveness to me.
PS. It's too bad the guy wasn't a BYU football player. Then he'd have lots of support, eh?
