Why isn't "because he deserved it" a valid defense to homicide? It should be. Perhaps "the world is a better place with him dead" would be a better approach?

The easy answer is because the collective gets to decide whether he deserves "it" through due process, not an individual. It is a crappy system but better than any other yet devised.
